Terms of Service

Please read these Terms carefully before using HireBee. They form a binding agreement between you and HireBee, Inc.

1. Acceptance of Terms

By accessing or using the HireBee platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using HireBee on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

HireBee provides an asynchronous video interview platform. Employers ("Users") can create job listings, compose interview questions, generate unique candidate invite links, and review recorded video responses within a hiring pipeline.

Candidates ("Respondents") access the platform via a unique link provided by an employer. Respondents do not require a HireBee account. By recording a video response, Respondents consent to their responses being stored and reviewed by the employer who invited them.

3. Accounts and Registration

  • You must provide accurate, current, and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at security@hirebee.io if you suspect any unauthorised access to your account.
  • You may not share your account or allow third parties to access the Service on your behalf without explicit permission.
  • We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion, with reasonable notice where practicable.

4. Subscriptions and Billing

HireBee offers a free tier and paid subscription plans ("Pro", "Enterprise") as detailed on our Pricing page. Paid plans are billed in advance on a monthly or annual basis via Stripe.

  • All fees are non-refundable except where required by applicable law or at our sole discretion.
  • You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
  • If your payment fails, we will notify you and provide a grace period to update your payment method. After the grace period, your account may be downgraded to the Free plan.
  • We reserve the right to change pricing with at least 30 days written notice to active subscribers.
  • Enterprise pricing is custom and governed by a separate agreement.

5. Acceptable Use

You agree to use HireBee only for lawful purposes and in compliance with all applicable laws, including employment and anti-discrimination laws in your jurisdiction. You must not:

  • Ask interview questions that are discriminatory on the basis of race, colour, religion, sex, national origin, age, disability, sexual orientation, or any other protected characteristic.
  • Use the platform to collect data for purposes other than evaluating candidates for legitimate employment.
  • Attempt to reverse-engineer, scrape, or otherwise access the platform in ways not intended by these Terms.
  • Upload, transmit, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Introduce malware, viruses, or any other malicious code.
  • Use automated tools, bots, or scripts to interact with the Service without written permission.

6. Candidate Data and Employer Responsibility

When you invite a candidate to complete a video interview, you become the data controller for that candidate's personal information and video responses. You are responsible for:

  • Obtaining any necessary consents required by applicable law before inviting candidates.
  • Ensuring your use of candidate data complies with data protection laws in your jurisdiction, including GDPR where applicable.
  • Deleting or requesting deletion of candidate data when it is no longer needed for hiring purposes.
  • Not sharing candidate video responses with parties outside your organisation without the candidate's consent.

HireBee acts as a data processor on your behalf for candidate data. Our processing activities are governed by the Data Processing Addendum available at hirebee.io/dpa.

7. Intellectual Property

HireBee and its licensors own all rights in the platform, including the software, design, trademarks, and content we create. Nothing in these Terms transfers any of those rights to you.

You retain ownership of the content you create on the platform (job descriptions, questions). You grant HireBee a limited, non-exclusive licence to store, process, and display that content solely to provide the Service.

You may not use our trademarks, logos, or brand assets without prior written consent.

8. Privacy

Your use of HireBee is also governed by our Privacy Policy, available at hirebee.io/privacy. The Privacy Policy is incorporated into these Terms by reference.

9. Third-Party Services

HireBee integrates with third-party services including Stripe (payments), Supabase (database and storage), and Vercel (hosting). Your use of these services through HireBee is subject to their respective terms of service.

We are not responsible for the availability, accuracy, or conduct of any third-party service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not guarantee the accuracy or completeness of any information on the platform.

HireBee is a tool to facilitate your hiring process. We make no representations or warranties about the quality, suitability, or fitness of any candidate for any role.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIREBEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you paid to HireBee in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless HireBee, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

13. Termination

Either party may terminate the agreement at any time. You may close your account by contacting support@hirebee.io. We may suspend or terminate your access immediately and without notice if you breach these Terms.

On termination, your right to access the Service ceases. We will delete your data in accordance with our Privacy Policy and data retention schedule. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in San Francisco, CA.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against HireBee.

15. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
